Terms & Conditions

Majorpower Corporation takes pride in being flexible and easy to deal with, within a framework of basic business practices listed below:

Pricing:
Published prices are stated in $US dollars. Quoted shipping rates are for the continental 48 states only.  All prices are effective date of sale and are subject to change or discontinuance without notice.  Majorpower reserves the right to correct typographical errors and may accept or reject any purchase order at its sole discretion.

Payment:
Payments prior to shipping for customers without established credit can be made by Bank Funds Transfer.  Net 30 terms are granted to rated accounts utilizing only ACH, upon pre-arrangement and accounting department review.  New account approvals may take up to 2 weeks to process. All opening orders must be prepaid.

Prepayment with order by funds wire transfer in $USD to:
Bank Name: Wells Fargo Bank N.A.      Credit To: Majorpower Corporation
Routing # and Account # will be supplied with Purchase Order confirmation.

Freight & Taxes:
Freight charges can be prepaid by Majorpower and added to the invoice for domestic 50 states of USA. Unless a preference is indicated, products will be shipped “best way”.  Client may designate its own shipper upon provision of direct-bill shipping account number. ref:Using Carrier Terms  All sales taxes will be charged as required by law.  International (export from USA) – Shipping via a UPS account to a freight forwarder with a USA hub point may be more economical. The EXPORT drop-ship fee of $45 applies unless a USA freight forwarder address is provider with the purchase order.  Broker of Record must be declared in the PO instructions. Import duties, taxes and brokerage fees are the responsibility of the recipient.

Shipment:
All shipments are FCA our dock which means that the title of the equipment transfers to the owner once we pass the carton to the first carrier.  Shipments may be insured at the client’s request and cost. If customers ask for the additional service of product insurance to their location {destination}, we will purchase, on your behalf, UPS Ground Insurance and include the charge on the invoice as a line item. Warranties:
Manufacturers’ warranties are provided for all products Majorpower sells.  Client must process any warranty claims according to the manufacturers’ instructions.  Majorpower makes no warranties which extend beyond the description of the materials ordered.  All other warranties, either express or implied, including but not limited to warranties as to merchantability or fitness for a particular purpose, are hereby expressly excluded.

Returns & Claims:
Returns request must be made promptly within 30 days of shipment and must be expressly authorized by Majorpower (Case/RMA # required).  All returns are subject to a restocking fee of thirty percent (30%) of the purchase price. Majorpower will accept for return only new, standard stock, non-defective, unused, in warranty, and originally packaged products.  All returns are subject to receiving inspection before credits can be processed.

All claims for unsatisfactory shipment of goods must be made within forty-eight (48) hours of receipt of goods.  If Majorpower does not accept client’s order or cause client’s order to be delivered, the sole liability of Majorpower is to refund any amounts already paid.  Under no circumstances will Majorpower be liable for incidental or consequential damages.

Custom Orders:
Special orders or custom configured products are NOT returnable.  Full prepayment for custom orders under $5,000 is required. Minimum prepayment of 50% with orders over $5,000 is required; final payment must be received before shipping. Purchase orders for custom units must be “irrevocable” and non-returnable.

By placing an order with Majorpower, client has agreed to above terms and conditions in respect to aforementioned order and any subsequent orders, and no modifications or other terms are binding on Majorpower without prior written approval.

Delaware State law applies.
